EXPLANATION:

Bolded is the proposed text and below it is the explanation.

(d) One legislator, one vote. Any person who votes for another member of the Legislature is guilty of a felony. A legislator's vote is not valid unless the legislator is present and places the vote personally.

One need merely sit in on a legislative session to see legislators voting for other legislators. Sometimes it is completely well-meaning, but other times as can be seen in this investigative TV report, it is a total mockery of democracy. Fast forward through the first 30 seconds.

Most states have some kind of house rule that is supposed to prohibit this kind of conduct, but as can be seen, house rules are not laws and are easily ignored.

Some feel that voting by proxy should be permitted. However, without being present for the actual vote, a legislator is quite possibly missing out on key information presented in the debate that could change that legislator's vote or improve the bill, thereby resulting in an uninformed vote or sloppy legislation. We want deliberation and debate. We want the most efficient and effective laws possible to be passed. Voting by proxy does not help accomplish this.
